The Welsh Ministers, in exercise of the power conferred on them by section 49(3)(e) of the Flood and Water Management Act 2010[^f00001] make the following Order:

The title of this Order is the Flood and Water Management Act 2010 (Commencement No.9) Order 2014.

Provision coming into force on 1st January 2015

Section 45 of the Flood and Water Management Act 2010, so far as not already commenced and in relation to an undertaker whose area is wholly or mainly in Wales, comes into force on 1 January 2015.

Explanatory note

EXPLANATORY NOTE

This Order brings into force provisions of the Flood and Water Management Act 2010^f00002.

Section 45 of the 2010 Act inserted a new section 144C into the Water Industry Act 1991[^f00003]. That section imposes a duty on owners of residential premises who do not occupy those premises to arrange for information about the occupiers to be given to the relevant water and/or sewerage undertaker.

The power of the Welsh Ministers to make regulations about the information to be given was commenced by the Flood and Water Management Act 2010 (Commencement No.1 and Transitional Provisions) Order 2010[^f00004].

Article 2 of this Order specifies that section 45 of the 2010 Act, so far as not already commenced and in relation to undertakers whose areas are wholly or mainly in Wales, comes into force on 1 January 2015.
