The Agricultural Sector (Wales) Act 2014 (Consequential Modification) Order 2015

Coming into force: 9 December 2015

In accordance with section 17(2) of that Act, a draft of this instrument was laid before and approved by resolution of the National Assembly for Wales.

Title, commencement and application

• (1) The title of this Order is the Agricultural Sector (Wales) Act 2014 (Consequential Modification) Order 2015 and it comes into force on 9 December 2015.

• (2) This Order applies in relation to Wales.

Modification of the National Minimum Wage Act 1998

Section 46(4) of the National Minimum Wage Act 1998[^f00002] is modified as follows—

• (a) at the end of paragraph (b) omit “and”;

• (b) at the end of paragraph (c) insert—

; and (d) the Agricultural Sector (Wales) Act 2014.

Explanatory note

(This note is not part of the Order)

EXPLANATORY NOTE

This Order makes a consequential modification to the National Minimum Wage Act 1998 (“the 1998 Act”).

Article 2 of this Order amends section 46(4) of the 1998 Act by inserting a reference to the Agricultural Sector (Wales) Act 2014 (“the 2014 Act”). The provision ensures that a person cannot be prosecuted under both the 1998 Act and the 2014 Act for an offence arising out of the same conduct.

A Regulatory Impact Assessment has not been prepared for this Order as no impact on the public, private, charity or voluntary sectors is foreseen.
