The Code of Practice in relation to Local Authority Fostering Services (Appointed Day) (Wales) Order 2019

In accordance with section 146(2) of the 2014 Act, a draft of the code was laid before the National Assembly for Wales for 40 days.

Title and interpretation

• (1) The title of this Order is the Code of Practice in relation to Local Authority Fostering Services (Appointed Day) (Wales) Order 2019.

• (2) In this Order, “the code” means the code of practice in relation to local authority fostering services which was issued by the Welsh Ministers on 17 May 2019.

Appointed day

The day appointed for the coming into force of the code is 20 May 2019.

Explanatory note

EXPLANATORY NOTE

Section 145(1) of the Social Services and Well-being (Wales) Act 2014 (anaw 4) (“the 2014 Act”) enables the Welsh Ministers to issue codes on the exercise of social services functions. Section 145(3) of the 2014 Act requires local authorities, when exercising social services functions, to act in accordance with any relevant requirements contained in a code and to have regard to any relevant guidelines contained in the code.

The Local Authority Fostering Services (Wales) Regulations 2018 (S.I. 2018/1339 (W. 261)) (“the Regulations”) (as amended by the Local Authority Fostering Services (Wales) (Amendment) Regulations 2019 (S.I. 2019/545 (W. 119)) impose requirements on local authority fostering services providers and managers in relation to the provision of fostering services.

The code of practice in relation to local authority fostering services (“the code”) sets out guidance on how local authority fostering services providers and managers may comply with the requirements imposed by the Regulations. The code was issued by the Welsh Ministers on 17 May 2019. This Order appoints 20 May 2019 as the day on which the code comes into force.
