The Government of Maintained Schools (Training Requirements for Governors) (Wales) (Amendment) Regulations 2024

The Welsh Ministers, in exercise of the powers conferred on them by sections 22(3) and (4) and 32(2) of the Education (Wales) Measure 2011[^f00001], make the following Regulations.

Title, coming into force and interpretation

• (1) The title of these Regulations is the Government of Maintained Schools (Training Requirements for Governors) (Wales) (Amendment) Regulations 2024.

• (2) These Regulations come into force on 9 September 2024.

• (3) In these Regulations, “the 2013 Regulations” means the Government of Maintained Schools (Training Requirements for Governors) (Wales) Regulations 2013[^f00002].

Amendments to the 2013 Regulations

• (1) The 2013 Regulations are amended as follows.

• (2) In regulation 2(1) (interpretation)—

• (a) in the definition of “the chair training” for “in September 2013 and called “Content of the training for chairs of governors in Wales””, substitute “on the gov.wales website[^f00003] in July 2024 and called “Training for chairs of governors in Wales””, and

• (b) in the definition of “the induction training” for “in September 2013 called “Content of induction training for governors in Wales””, substitute “on the gov.wales website[^f00004] in July 2024 and called “Induction training for school governors in Wales””.

• (3) In regulation 3 (chair training), after paragraph (3) insert—

(4) A local authority in Wales must secure the provision of the chair training, free of charge, to every chair of a governing body of a maintained school it maintains within the period set out in paragraph (1).

• (4) In regulation 4 (induction training), after paragraph (6) insert—

(7) A local authority in Wales must secure the provision of the induction training, free of charge, to every governor of a maintained school it maintains within the period set out in paragraph (1).

• (5) In regulation 5 (school performance data training), after paragraph (6) insert—

(7) A local authority in Wales must secure the provision of the school performance data training, free of charge, to every governor of a maintained school it maintains within the period set out in paragraph (1).

Saving provisions

• (1) Nothing in these Regulations applies to—

• (a) a chair of a governing body who completed the chair training required by regulation 3(1) of the 2013 Regulations before the coming into force of these Regulations, or

• (b) a governor who completed the induction training required by regulation 4(1) of the 2013 Regulations before the coming into force of these Regulations.

• (2) In this regulation—

• (a) “chair of a governing body” has the meaning given by regulation 2(1) of the 2013 Regulations;

• (b) “a governor” has the meaning given by regulation 2(1) of the 2013 Regulations.

Explanatory note

(This note is not part of the Regulations)

EXPLANATORY NOTE

The Government of Maintained Schools (Training Requirements for Governors) (Wales) Regulations 2013 (“the 2013 Regulations”) set out the training requirements for governors at maintained schools in Wales.

The 2013 Regulations provide that the current training required to be completed by a chair of a governing body is set out in a document called “Content of the training for chairs of governors in Wales” (“the 2013 training for chairs document”). Regulation 2(2)(a) of these Regulations amends the 2013 Regulations to replace the reference to the 2013 training for chairs document with reference to the new chair training document called “Training for chairs of governors in Wales” published in July 2024 (“the 2024 training for chairs document”). It can be found on the Welsh Government website at www.gov.wales.

The 2013 Regulations provide that the current induction training requirements for governors are set out in a document called “Content of induction training for governors in Wales” (“the 2013 induction training document”). Regulation 2(2)(b) of these Regulations amends the 2013 Regulations to replace the reference to the 2013 induction training document with reference to the new induction training document called “Induction training for school governors in Wales” published in July 2024 (“the 2024 induction training document”). It can be found on the Welsh Government website at www.gov.wales.

Regulation 2(3) of these Regulations inserts a new paragraph (4) into regulation 3 of the 2013 Regulations to require the local authority that maintains a school to secure provision of the chair training free of charge. Regulation 2(4) of these Regulations inserts a new paragraph (7) into regulation 4 of the 2013 Regulations to require the local authority that maintains a school to secure the provision of the induction training free of charge. Regulation 2(5) of these Regulations inserts a new paragraph (7) into regulation 5 of the 2013 Regulations to require the local authority that maintains a school to secure the provision of the school performance data training free of charge. The school performance data training requirements for governors are set out in a document called “Training for school governors in Wales: understanding the role of data in supporting self-evaluation and improvement in schools”, and is referred to in the definition of “the school performance data training” in regulation 2(1) of the 2013 Regulations. It can be found on the Welsh Government website at www.gov.wales.

Regulation 3(a) of these Regulations contains a saving provision to ensure that existing chairs of governing bodies do not have to complete the chair training in line with the 2024 training for chairs document if they have already completed the chair training required by the 2013 Regulations before these Regulations came into force.

Regulation 3(b) of these Regulations contains a saving provision to ensure that existing school governors do not have to complete the induction training in line with the 2024 induction training document if they have already completed the induction training required by the 2013 Regulations before these Regulations came into force.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, a regulatory impact assessment has been prepared as to the likely costs and benefits of complying with these Regulations.
