The Welsh Ministers make the following Regulations in exercise of the powers conferred on them by section 32(4) of the Tertiary Education and Research (Wales) Act 2022[^f00001].

Title and coming into force

(1) The title of these Regulations is the Higher Education (Qualifying Courses and Qualifying Persons) (Wales) (Amendment) Regulations 2026.

(2) These Regulations come into force on 31 March 2026.

Amendment to regulation 3 of the Higher Education (Qualifying Courses and Qualifying Persons) (Wales) Regulations 2026

In regulation 3(2) of the Higher Education (Qualifying Courses and Qualifying Persons) (Wales) Regulations 2026[^f00002], in condition 1, for paragraph (1)(e) of that condition in the English language text substitute—

(e) a course for the Higher National Diploma or Higher National Certificate of the Business and Technician Education Council, or the Diploma in Management Studies,

Explanatory Note

These Regulations amend the Higher Education (Qualifying Courses and Qualifying Persons) (Wales) Regulations 2026 to correct an error in those Regulations.

Regulation 2 amends the English language text of paragraph (1)(e) of condition 1 in regulation 3(2) of those Regulations by inserting the correct text, which relates to courses leading to the Higher National Diploma or the Higher National Certificate of the Business and Technician Education Council or the Diploma in Management Studies.

The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to these Regulations. As a result, it was not considered necessary to carry out a regulatory impact assessment as to the likely costs and benefits of complying with these Regulations.
